<p>La propriété d’usage d’un bien immobilier est une forme de propriété qui repose sur l’utilisation qu’en font ses usager·ères, plutôt que par la détention d’un titre de propriété marchand. En l’occurrence, il s’agit des collectifs qui occupent la CCKali. Née en 2017, elle accueille les permanences, réunions ou activités d’une dizaine d’associations. « <em>On l’a créée parce qu’il manquait un lieu en centre-ville libre d’accès et pas cher pour des structures qui n’ont pas leurs propres locaux</em> », retrace Marco, l’un des cofondateurs de cet espace qui est occupé quasiment tous les jours.</p>\n

<p>Il y a environ six ans, le propriétaire de l’immeuble qui abrite la CCKali décide de vendre. Une vraie tuile pour la cafétéria qui bénéficiait jusque-là d’un loyer « modéré » : « <em>On savait que ça ne serait pas possible pour un lieu comme Kali de continuer à payer un loyer plus élevé, avec le changement de propriétaire</em> », explique Lise, de l’ASBL Voix de femmes. « <em>On est vraiment à la frontière du quartier Saint-Léonard,</em> poursuit Tam, membre du Front anti-expulsion, qui tient une permanence tous les mardis<em>. Ça reste assez populaire, mais c’est ici que l’immobilier augmente le plus, avec le quartier des Guillemins. Ça se gentrifie, entre autres à cause du tram et du fait qu’on ne régule pas les loyers. Du coup, c’est le marché privé qui décide.</em> »</p>\n

<p>Le propriétaire veut que son bien soit racheté par le collectif, mais celui-ci n’en a pas les moyens. « <em>Le bâtiment était en vente à 300.000 €, ce à quoi il fallait ajouter les frais de notaire et la réalisation de travaux urgents. Il fallait réunir environ 400.000 €, dont 350 incompressibles</em> », raconte Émilie, usagère du lieu.</p>\n

<p>Commence alors une longue période de réflexion politique autour des alternatives à la propriété privée. Un groupe de travail chargé du potentiel rachat du bâtiment prend connaissance d’initiatives en France et en Allemagne. « <em>On s’est inspirés d’une réflexion émanant des coopératives agricoles des années 1970, qui ont eu souvent des problèmes lors des transmissions, </em>détaille Marco<em>. Quand les enfants héritaient, ils voulaient récupérer l’argent et se foutaient du projet. Donc, les paysan·nes ont essayé de trouver une autre forme de propriété qui protégeait mieux les usages.</em> »</p>\n

<p>Après quatre années de discussions, le montage financier est fixé : on crée une fondation (qui s’appellera Mur par Mur) qui achète le bien et en est donc la propriétaire. C’est elle qui donne l’usage et la gestion des lieux à l’ASBL La Demeure (créée pour l’occasion) via un bail emphytéotique de 99 ans. « <em>La Demeure paie 6.500 € par an de loyer à Mur par Mur. Concrètement, ce bien ne vaut rien sur le marché</em> », sourit Marco. C’est précisément l’objectif de la manœuvre : soustraire le bien à la spéculation immobilière, pour le gérer collectivement et le destiner à des usages non marchands sur la durée.</p>\n

<p>Des garde-fous ont été imaginés pour préserver la raison politique de la création de Kali, et garantir la pérennité de cet espace militant dans le quartier. « <em>Ce bail ne peut pas être cassé n’importe comment mais le but, c’est que ça puisse l’être si jamais il est repris dans le futur, et que les choses évoluent dans un esprit capitaliste</em> », souligne Lise, également membre de l’organe d’administration de La Demeure.</p>\n

<p>Une fois le montage juridique échafaudé, encore fallait-il pouvoir réunir l’argent nécessaire au rachat. Le propriétaire accepte un compromis de vente qui bloque le prix de base. « <em>On lui a fait signer une promesse d’achat de 2.000 €. Ça nous laissait deux ans pour réunir la somme</em> », se remémore Marco. Grâce à la mobilisation des collectifs usagers, le pari est relevé. Plus de 500 donateur·ices, uniquement mobilisé·es via le bouche-à-oreille, participent au rachat. 224.000 € de dons et 120.000 € de prêts-amis (sur cinq à quinze ans, sans taux d’intérêt) sont récoltés.</p>\n

<p>Aujourd’hui, La Demeure doit trouver de nouveaux prêteur·euses pour prendre le relais des premiers, ou refaire une campagne de levée de fonds. <p>La propriété d’usage d’un bien immobilier est une forme de propriété qui repose sur l’utilisation qu’en font ses usager·ères, plutôt que par la détention d’un titre de propriété marchand. En l’occurrence, il s’agit des collectifs qui occupent la CCKali. Née en 2017, elle accueille les permanences, réunions ou activités d’une dizaine d’associations. « <em>On l’a créée parce qu’il manquait un lieu en centre-ville libre d’accès et pas cher pour des structures qui n’ont pas leurs propres locaux</em> », retrace Marco, l’un des cofondateurs de cet espace qui est occupé quasiment tous les jours.</p>\n

<p>Il y a environ six ans, le propriétaire de l’immeuble qui abrite la CCKali décide de vendre. Une vraie tuile pour la cafétéria qui bénéficiait jusque-là d’un loyer « modéré » : « <em>On savait que ça ne serait pas possible pour un lieu comme Kali de continuer à payer un loyer plus élevé, avec le changement de propriétaire</em> », explique Lise, de l’ASBL Voix de femmes. « <em>On est vraiment à la frontière du quartier Saint-Léonard,</em> poursuit Tam, membre du Front anti-expulsion, qui tient une permanence tous les mardis<em>. Ça reste assez populaire, mais c’est ici que l’immobilier augmente le plus, avec le quartier des Guillemins. Ça se gentrifie, entre autres à cause du tram et du fait qu’on ne régule pas les loyers. <p>Le propriétaire veut que son bien soit racheté par le collectif, mais celui-ci n’en a pas les moyens. « <em>Le bâtiment était en vente à 300.000 €, ce à quoi il fallait ajouter les frais de notaire et la réalisation de travaux urgents. Il fallait réunir environ 400.000 €, dont 350 incompressibles</em> », raconte Émilie, usagère du lieu.</p>\n

<p>Commence alors une longue période de réflexion politique autour des alternatives à la propriété privée. Un groupe de travail chargé du potentiel rachat du bâtiment prend connaissance d’initiatives en France et en Allemagne. « <em>On s’est inspirés d’une réflexion émanant des coopératives agricoles des années 1970, qui ont eu souvent des problèmes lors des transmissions, </em>détaille Marco<em>. Quand les enfants héritaient, ils voulaient récupérer l’argent et se foutaient du projet. Donc, les paysan·nes ont essayé de trouver une autre forme de propriété qui protégeait mieux les usages.</em> »</p>\n

<p>Après quatre années de discussions, le montage financier est fixé : on crée une fondation (qui s’appellera Mur par Mur) qui achète le bien et en est donc la propriétaire. C’est elle qui donne l’usage et la gestion des lieux à l’ASBL La Demeure (créée pour l’occasion) via un bail emphytéotique de 99 ans. « <em>La Demeure paie 6.500 € par an de loyer à Mur par Mur. Concrètement, ce bien ne vaut rien sur le marché</em> », sourit Marco. C’est précisément l’objectif de la manœuvre : soustraire le bien à la spéculation immobilière, pour le gérer collectivement et le destiner à des usages non marchands sur la durée.</p>\n

<p>Des garde-fous ont été imaginés pour préserver la raison politique de la création de Kali, et garantir la pérennité de cet espace militant dans le quartier. « <em>Ce bail ne peut pas être cassé n’importe comment mais le but, c’est que ça puisse l’être si jamais il est repris dans le futur, et que les choses évoluent dans un esprit capitaliste</em> », souligne Lise, également membre de l’organe d’administration de La Demeure.</p>\n

<p>Une fois le montage juridique échafaudé, encore fallait-il pouvoir réunir l’argent nécessaire au rachat. Le propriétaire accepte un compromis de vente qui bloque le prix de base. « <em>On lui a fait signer une promesse d’achat de 2.000 €. Ça nous laissait deux ans pour réunir la somme</em> », se remémore Marco. Grâce à la mobilisation des collectifs usagers, le pari est relevé. Plus de 500 donateur·ices, uniquement mobilisé·es via le bouche-à-oreille, participent au rachat. 224.000 € de dons et 120.000 € de prêts-amis (sur cinq à quinze ans, sans taux d’intérêt) sont récoltés.</p>\n
